CreativeModuleWorks ("we", "us", "our") is committed to protecting your personal data in compliance with Regulation (EU) 2016/679 (General Data Protection Regulation — GDPR) and applicable Spanish data protection laws.
1. Data We Collect
When you submit an inquiry through our contact form, we collect your first name, last name, email address, phone number (optional), service interest, and project details. We also collect standard server logs including IP address, browser type, and access timestamps for security purposes.
2. Purpose of Processing
Your personal data is processed exclusively for: (a) responding to your project inquiry and providing technical proposals; (b) delivering contracted creative development services; (c) maintaining communication regarding active projects; and (d) complying with applicable tax and accounting regulations.
3. Legal Basis
We process your data based on: (a) your explicit consent given upon form submission (Article 6(1)(a) GDPR); (b) performance of a contract or pre-contractual measures at your request (Article 6(1)(b) GDPR); and (c) our legitimate interest in ensuring platform security and preventing abuse (Article 6(1)(f) GDPR).
4. Data Retention
Inquiry data is retained for a maximum of 24 months from the date of submission unless a contractual relationship is established, in which case data is retained for the duration of the engagement plus 6 years as required by Spanish tax law.
5. Your Rights
Under GDPR, you have the right to: access your personal data, rectify inaccurate data, request erasure ("right to be forgotten"), restrict processing, data portability, and object to processing. You may exercise these rights by contacting us at [email protected].
6. Data Transfers
We do not transfer personal data outside the European Economic Area (EEA) without appropriate safeguards. Any third-party service providers we engage are contractually obligated to maintain GDPR-compliant data processing standards.
7. Security
We implement appropriate technical and organizational measures including TLS encryption, access controls, regular security audits, and encrypted data storage to protect your personal information against unauthorized access, alteration, or destruction.
Terms of Service
TOS1. Acceptance of Terms
By engaging the services of CreativeModuleWorks, located at Calle Carabela Santa María, 10, 11130 Chiclana de la Frontera, Cádiz, Spain, you ("Client") agree to be bound by these Terms of Service. These terms govern all creative development, design, consulting, and related services provided by CreativeModuleWorks.
2. Scope of Services
All services are defined in individual Statements of Work (SOW) or project proposals issued by CreativeModuleWorks. Each SOW specifies deliverables, timelines, pricing, and acceptance criteria. Services not explicitly included in an approved SOW are outside the scope of the engagement.
3. Intellectual Property
Upon complete settlement of all agreed invoices, CreativeModuleWorks assigns all worldwide intellectual property rights in the client-specific deliverables — including source code, design assets, and creative materials — directly to the Client. CreativeModuleWorks retains the right to display anonymized case studies and portfolio excerpts unless the Client objects in writing.
4. Payment Terms
Invoices are payable within 14 days of issuance unless otherwise specified in the SOW. A 50% advance payment is required before project commencement for projects exceeding €1,000. Late payments accrue interest at a rate of 0.05% per day on the outstanding balance. All prices are quoted in EUR or USD as specified.
5. Project Timelines
Delivery timelines are estimated in good faith and commence upon receipt of the advance payment and all required Client-provided materials. Delays in Client-provided inputs, feedback, or approvals will proportionally extend the delivery timeline. CreativeModuleWorks will communicate any anticipated delays promptly.
6. Limitation of Liability
CreativeModuleWorks' total aggregate liability under any engagement shall not exceed the total fees paid by the Client for the specific service giving rise to the claim. CreativeModuleWorks shall not be liable for indirect, incidental, consequential, or punitive damages including lost profits, data loss, or business interruption.
7. Termination
Either party may terminate an engagement with 14 days' written notice. Upon termination, the Client is responsible for payment of all work completed up to the termination date. CreativeModuleWorks will deliver all completed work products within 7 business days of termination notice.
8. Governing Law
These Terms are governed by the laws of Spain. Any disputes arising from or relating to these Terms or the services provided shall be subject to the exclusive jurisdiction of the courts of Cádiz, Spain.
Refund & Reimbursement Policy
RefundsCreativeModuleWorks, located at Calle Carabela Santa María, 10, 11130 Chiclana de la Frontera, Cádiz, Spain, is committed to fair and transparent refund practices for all creative development services.
1. Pre-Project Cancellation
If you cancel a project before any work has commenced, you are entitled to a full refund of any advance payment within 10 business days. Cancellation requests must be submitted in writing to [email protected].
2. Partial Refunds During Active Projects
If a project is cancelled after work has begun, a partial refund may be issued based on the percentage of work completed at the time of cancellation. The Client will receive an itemized breakdown of completed vs. remaining work to justify the calculation. Any completed and delivered work products remain the property of the Client upon payment for that portion.
3. Non-Delivery Refund
If CreativeModuleWorks fails to deliver the agreed-upon deliverables as specified in the Statement of Work within 30 days beyond the agreed deadline (and the delay is not attributable to Client actions or force majeure), the Client is entitled to a full refund of all payments made for the undelivered portion of the project.
4. Defective Deliverables
If delivered work materially fails to meet the specifications outlined in the SOW, the Client must notify CreativeModuleWorks within 14 days of delivery. CreativeModuleWorks will have 14 business days to remedy the defect at no additional cost. If remediation is not feasible, a partial or full refund will be negotiated in good faith.
5. Non-Refundable Items
Third-party costs incurred on behalf of the Client (including but not limited to software licenses, stock assets, hosting fees, and domain registrations) are non-refundable once purchased. Consultation fees for work already performed are also non-refundable.
6. Refund Process
All refund requests are reviewed within 5 business days of receipt. Approved refunds are processed via the original payment method within 10 business days. For questions regarding refunds, contact [email protected].
